Is It Allowed to Wear a Necklace With the German Eagle?

This is a question we get asked a lot. Section 124 of the German Administrative Offences Act (OWiG) protects the federal coat of arms, the Federal Eagle and the federal service flag from unauthorised use. According to legal commentary, the decisive factor is whether the use creates "the appearance of official use" (cf. BeckOK OWiG/Weiner, 43rd Ed. 2024, § 124 para. 3). The Research Services of the German Bundestag state in their report WD 7-062/24 that socially customary uses are considered permissible – explicitly mentioning patches, folk festivals and souvenirs. Whether a use is "unauthorised" depends on whether the viewer gets the impression of an official connection – such as a government endorsement or inspection. A necklace with an eagle motif worn as personal jewellery typically does not create this impression. It is clearly perceived as an individual accessory, not as an official emblem. What Does the Federal Eagle Mean and How Old Is It?

The eagle on our Germany necklaces has a history that goes far beyond the Federal Republic. The eagle has been a German symbol of rule and heraldry since the 12th century. In antiquity, it represented sovereignty and strength as a messenger of the gods – symbolising Zeus for the Greeks and Jupiter for the Romans. By around 1200, the black eagle on a golden background was recognised as the imperial coat of arms, and throughout the Middle Ages, kings and imperial princes bore the eagle on their shields. The current design dates back to a 1926 work by graphic artist Tobias Schwab, originally created for the Weimar Republic. In 1950, Federal President Theodor Heuss adopted this coat of arms as a deliberate symbol of democratic continuity for the young Federal Republic. Interestingly, there is no single binding depiction of the Federal Eagle. The Bundestag, Bundesrat and Federal Constitutional Court each use slightly different versions. The eagle is thus one of the oldest surviving European state symbols – and one that unites tradition, democracy and identity.
